These terms govern orders placed with Sabji Wala Kanpur through our website, apps, POS and assisted WhatsApp ordering.
Electronic record
This document is an electronic record under the Information Technology Act, 2000 and applicable rules concerning electronic records. It is generated by a computer system and does not require a physical or digital signature.
Platform owner and scope
The website sabjiwalakanpur.com, its related mobile experiences and order channels are operated under the business name Sabji Wala Kanpur from 119/97, Bamba Road, Darshanpurwa, Kanpur, Uttar Pradesh 208012. In these terms, “we”, “us” and “our” refer to Sabji Wala Kanpur, while “you” and “user” refer to a customer or lawful user of the platform.
Acceptance and updates
By accessing the platform, creating an account or placing an order, you agree to these Terms and the linked Privacy, Refund, Return and Delivery Policies. We may update these terms prospectively to reflect service, legal or operational changes; the effective date shown on this page identifies the applicable version.
Account information
You agree to provide true, accurate and complete registration, address and delivery information and to keep access to your registered mobile number secure. You are responsible for lawful activity performed through your account, except where caused by our own security failure.
Ordering and acceptance
An order is accepted only after availability, serviceability, minimum-order value, delivery charges and payment status are verified. Fresh produce is subject to mandi availability and grading. If an item is unavailable or materially changes, we will ask for the customer’s consent before sending the remaining order.
Prices and payments
The final checkout shows item total, discounts, delivery and handling charges before confirmation. Online payments are considered successful only after server-side confirmation from the authorised payment gateway. Customers must never share a UPI PIN, OTP, CVV or password with our staff.
Delivery
Orders booked before the displayed daily cut-off may be scheduled for same-day delivery; later orders are booked for the next available date. Delivery estimates can change because of mandi supply, grading, packing, weather, traffic or a multi-order delivery route.
Cancellations and changes
Customers may request a change or cancellation before dispatch. Once fresh produce has been packed or dispatched, cancellation may be declined except where required by law or where we supplied a wrong, missing or damaged item.
Platform use and intellectual property
Platform content, branding, layout, graphics and software are owned by or licensed to Sabji Wala Kanpur. You may use the platform only for personal, lawful purchasing and support. Unauthorised copying, interference, fraudulent orders, security testing without written permission, or use that violates Indian law is prohibited.
Product information and natural variation
We take reasonable care to display current prices, pack sizes and descriptions. Fresh produce naturally varies in colour, shape, size and ripeness, and photographs are illustrative. Nothing in these terms excludes a customer’s rights where goods materially differ from the confirmed order or are unfit for consumption.
Third-party services
Payments, maps, messaging and other functions may be provided by authorised third parties. Their own terms and privacy notices apply when you use those services. A third-party link is provided for convenience and does not make us responsible for content outside our control.
Wallet and referral credit
Store wallet and referral rewards are closed-system credits usable only for eligible purchases from Sabji Wala Kanpur. They cannot be withdrawn as cash or transferred to a bank account, UPI account or another customer. Promotional credit may carry an expiry date shown with the offer.
Service availability and force majeure
We aim to keep the platform and delivery service available but do not guarantee uninterrupted access. We are not responsible for delay or non-performance caused by events reasonably beyond our control, including severe weather, market closure, transport disruption, government action, network failure or natural disaster; affected customer orders and refunds will still be handled under applicable law and policy.
Liability and indemnity
To the maximum extent permitted by law, liability is limited to direct loss arising from the affected order or service. You agree to be responsible for losses caused by your unlawful misuse of the platform, infringement of third-party rights or material breach of these terms. Nothing here limits liability or consumer remedies that cannot legally be excluded.
Contact, governing law and disputes
Questions or complaints may be raised through customer support. These terms are governed by the laws of India. Courts and competent consumer forums having jurisdiction in Kanpur, Uttar Pradesh may hear disputes, without restricting any forum or remedy available to a consumer under applicable law.
